Sales terms & Warranty for CREAVEST BV (hereafter called ‘the seller’)

Article 1: Price

All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately. All articles are shipped by DOU CARE, collection on site is not possible. A charge will be made for this shipping. These are mentioned in the check-out process.

The statement of price refers only to the items as it is described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

Article 2: Offers

Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind DOU CARE. DOU CARE is with regard to the correctness and completeness of the offered information only held to a means obligation. DOU CARE is in no case liable in case of manifest material errors, typesetting or printing errors.

If the Customer has specific questions regarding e.g. availability, delivery time or delivery method, we request the Customer to contact our customer service department in advance.

The offer is always valid while supplies last and may be modified or withdrawn by DOU CARE at any time. DOU CARE cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly mentioned in the offer.

Article 3: Online purchases

The ordering procedure is as follows: the Customer places items in his/her shopping cart, then the Customer clicks through to the ‘checkout’ where an overview of the shopping cart is displayed. Next, the Customer must log in or register with a new customer profile. Confirmation is done via the e-mail address the Customer provides. Then the Customer chooses the shipping option and payment option. Finally, the Customer accepts the General Terms and Conditions (this document) and the sales contract is concluded. For payments via fill-in forms, the Customer leaves the desired data, after which they are redirected to a secure online payment platform.

The Customer has the choice between the following payment methods

  • Bancontact
  • Credit card
  • KBC/CBC Pay Button
  • Belfius Pay Button
  • iDEAL

DOU CARE is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders involving the Customer.

Article 4: Shipping and return policy

Items ordered through this online store are delivered via online delivery via E-mail from the Customer.

The delivery of physical products is done by bPost, DHL or another parcel service and for this the Customer pays additional costs, as mentioned in the order procedure.

Shipping in Belgium will be handled at 2 rates, a flat rate of € 9,99 for orders, with a free shipping rate enabled starting from a minimum ordering amout of € 75.

Shipping in Europe will be handled at 2 rates, a flat rate of € 19,99 for orders, with a free shipping rate enabled starting from a minimum ordering amout of € 75. 

Unless otherwise agreed or expressly stated otherwise, the goods will be delivered to the Customer’s residence within 30 days after receipt of the order or after payment via e-mail in the case of aa purchase via web forms.

Any visible damage and/or qualitative deficiency of an article or other shortcoming in the delivery must be reported by the Customer to DOU CARE without delay.

The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier was instructed by the Customer to transport the goods and this choice was not offered by DOU CARE.

Article 5: Retention of title

The delivered articles remain the exclusive property of DOU CARE until the moment of full payment by the Customer.

The Customer undertakes, if necessary, to inform third parties of DOU CARE’s retention of title, e.g. to any person who would come to seize the not yet fully paid articles.

 

Article 6: Warranty

Under the Act of September 21, 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer must contact customer service and return the item to DOU CARE at the Customer’s expense.

If a defect is detected, the Customer must inform DOU CARE as soon as possible. In any case, any defect must be notified within a period of 2 months after its detection by the Customer. Thereafter, any right to repair or replacement expires.

The (commercial and/or legal) warranty is never applicable to defects arising as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 7: Customer service

DOU CARE’s customer service can be reached via e-mail at info@dou-care.be. Any complaints can be addressed to it.

Article 8: Penalties for non-payment

Without prejudice to the exercise of other rights available to DOU CARE, in case of non-payment or late payment, the Customer will be liable, ipso jure and without formal notice, to pay an interest of 10% per year on the unpaid amount from the date of the default. In addition, the Customer shall be liable ipso jure and without formal notice to pay a fixed indemnity of 10% on the amount involved, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, DOU CARE reserves the right to take back the articles not (fully) paid for.
